Borang 3, 4, & 5 (Short Call Papers)

Once Borang 1 & 2 is served to the relevant bodies (refer to my previous blog post), you would have to file in your Affidavit of Service. You can find a sample of the Affidavit of Service in the Pupil's Handbook by KL Bar, which by now you should already have a copy (just download it from the website). 

Next step is to obtain your short call order. Get your Borang 3 which is a "Saman Dalam Kamar", fill in the particulars as required. Next your Borang 4 is an Affidaviy in support of the Summons by your Pupil Master and Borang 5 is an Affidavit by the Pupil. Both has to be signed and affirmed in front of an Commissioner of Oaths. You can do this in Court, be it Shah Alam or KL, there is a counter for Comm of Oaths. Please check if your Master has to sign the affidavit before the commissioner at the counter. Some don't mind, some do. So check before you do this.

Once all the papers are filled and completed, proceed to file it in Court and wait for it to be extracted (usually will take about 2 days but if you're lucky you will get it the same day you filed provided you filed it early in the morning). Again, you're going to have to make copies, 3 to be exact. The Affidavits (Borang 4&5) make 3 copies and keep. Once your Summons is extracted, print 3 copies, attach it to the affidavit and serve to the relevant bodies. Same process, once served file in your Affidavit of Service.

Your Summons will stamped with a Hearing date in which your presence is not required. Those days, the master and pupil will have to attend the hearing and get the order in terms but however since the volume of pupils grew larger over the years, the courts excused the attendance of the master and pupils. But you would have to go and collect your letter of no objections from Bar Council Malaysia and KL Bar (depends on which state you're in) and serve to court a good three weeks before your hearing date. 

Once those letters of no objections have been sent to court, you will have to wait for your hearing date. On your hearing date, go to court and check the board for your petition num and name and whether it id PSP (Perintah Seperti Dipohon) or DT (Ditunda). If its PSP, then everything is in order and go back to your office to file your draft order. 

If its ditunda, that means your papers were not in order. Go to the counter and check with the clerk. Then wait till your next hearing date.  

Once you have filed your draft order, extract the same then file your fair order. There you go! you have your Short Call Order. Your short call order need not be served to the bodies but keep in mind that from the beginning of your Pupillage period to the end of the three months from the date of your short call order, you will not have any locus in court. 

Once your three months from the date of your short call order ends, then you will able to appear in court for simple mentions or case managements. If your master has the confidence in you he/she would probably allow you to do hearings but thats totally up to you masters. 

So people, good luck for your short call and I hope you enjoy your pupillage period because if your planning to practice after your 9 months, shit just got serious. So enjoy it while you can.

Reading!

Okay, so I'm an avid reader. I read whatever I find interesting. I started reading ever since I was a kid. The credit goes to my mom. She instilled my reading habit since I was 5 or 6. Since then I never stopped reading. During high school I was really into paranormal stuff. I started reading a lot about supernatural and paranormal books. I got hooked on writers like Jr. Ward, Sherrilyn Kenyon, Christine Feehan, Kerrilyn Sparks and Jeaniene Frost. The very first book I picked up on paranormal romance was by Christine Feehan titled Dark Demon. It was a book which was part of a series called Dark Carpathian Series. Of course at that point I didnt know it was part of the series, I still read the book and honestly, I got hooked. 

Then I started reading the whole series and started saving my allowance money from school to buy the books. Those novels weren't actually cheap. It costs about RM 32.90 per book and there were about 10 books that I needed to read to get where the plot was at that time. I started saving and bought one book every three months. Finally, over the years I am proud to say that I have her whole collection to date. 



While waiting for Feehan to write her books on the series, I slowly started venturing into other authors like Jr Ward and her series called the Black Dagger Brotherhood series, Sherrilyn Kenyon and her Dark Hunter Series and Jeaniene Frost and her Night Huntress Series and Kerrilyn Sparks and her Love At Stake Series, well I can say that I'm hooked on each and every one of their books. 






If you're looking to start on reading paranormal romance, I can tell you for sure that the authors that I have named above is a good place to start, yes, there are many authors of paranormal romance but these authors will have you hooked on their books like no other.


I can assure you 100% that these books will drive you mad with anticipation and suspense that you will be begging the writers to write more!! I know I do!

Niece's 21st birthday celebration!

We celebrated
my niece's 21st birthday. The whole family decided to celebrate her birthday at a restaurant called Restoran Zam Zam at Oasis 9, Shah Alam.


The Restaurant serves mostly Arab food. It's situated at a row of shoplots opposite of Concorde Hotel. They cater food and hall for functions like weddings, birthdays and engagement. The food served was quite tasty. I'm not that sure about their food at the restaurant itself, but judging by the food that was served at the party it was quite good.




The function was held at a small hall at the first floor of the restaurant. It caters for about 200 people. The decoration was done by the restaurant itself. All in all it was a very pleasant restaurant. The staff were friendly and willing to accomodate the guests requests. 

There was ample of parking space in front of the restaurant for the guests depending on the crowd. The restaurant also has another hall which bigger to cater for bigger functions like a wedding. There was a wedding hall equipped with lifts to the first and the second floor.   

I was really impressed with the ballroom and their concept of middle eastern decoration and their Arabic food. I would definitely go back there to try their food on the menu!

Chambering Process!

Okay, so I just started blogging and I was thinking what i should actually write about. The first thing that came to my mind was my Pupillage period. See, to qualify as a Lawyer, one would have to go through 9 months of Pupillage or it is also known as Chambering. This is where you train in the chambers of a senior lawyer for 9 months, hence 'Chambering'. 
The first step you do when you start chambering/pupillage is to get to know the firm that you will be chambering in. Well, lets face it, that office and its inhabitants will be your best friends for the nect 9 month of your life so you would be better off being friends with them whether you like it or not. The first few weeks at the beginning of your pupillage period will determine whether your life for the next 9 months will be miserable or a breeze. 

Once you're familiar with the firm, then start filling up your forms. The forms that you should be filling up is Borang 1 & 2. I know you're excited, I know you want to start your 9 months as soon as possible but believe me when I say don't rush when you're filling up the forms. One mistake, your form is rejected and you're going to have to put in a corrective affidavit. You can get the forms from Bar Council or check out from any one of your lawyers, they probably might have some forms with them. But do check with Bar council if those are the same formats. 

Your Borang 1 is significant because the date that you file the form would be the date you start your pupillage. From that date, exactly 9 months later, your pupillage ends. The suppoting affidavit to your Borang 1 is your Borang 2. Your going to have to sign it before a Commissioner of Oaths. Once affirmed, you're ready to file. Before that make sure the supporting documents for your Borang 1 is complete and is Certified by an advocate. Just ask one the lawyers in your firm to certify the copies. Please get it right, putting in corrective affidavits in the beginning of your chambering period is like jinxing your whole 9 months. Like I said, don't rush! Take you time, and get it right!

These are extremely helpful when your starting your pupillage. Once you filed your Borang 1 & 2, you're going to have to photocopy 32 sets of your Borang 2. If your filing it in KL, just go down to the Level B1 of Jalan Duta Court Complex, they will do it for you. You will have to take your 32 sets of your Borang 2 and send it to Level 2 - Bahagian Rayuan & Kuasa-Kuasa Khas (RKKK). You're going to have to make 3 sets of Borang 1 & 2, to serve those to the Bar Council, State Bar Committe (depends on which state your chambering in) and The Attorney Generals Chambers (AG). 

Once served on all the three bodies, you have to file in your Affidavit of Service containing the date and time you served on the bodies. When you're serving to the 3 bodies, make sure you get them to stamp the back of your original copy (filing copy). That copy you will have to exhibit it for your Affidavit of Service. Do your endorsement as well on the stamped page. File in your affidavit of service and you can now proceed to file your short call papers!

Intro!

Hey hey...

Well, this is the first time i'm blogging on a public domain! so if there's something wrong or something that's not right, bare with me kay!

Right, so I'm from a small town called Port Klang. Most people don't exactly know where Port Klang is.. Well let me tell you something, it is kinda at the far corner, well one corner of Selangor! I'm a practicing Lawyer in KL and I'm into creative writing. I don't know if people would read what i write but hey, you never know till you try right.

This blog will carry most of my ramblings, venting and the creative writing that I'm actually attempting to write. If you read something you like or dont like, please let me know! That would a huge help!
